Through the use of a hypothetical set of facts lifted from the pages of real life, this highly interactive program
will explore the often overlooked issue of mediator disclosure. Using the standards set forth in the California Rules of Court
as a guide, human circumstances and case dynamics will be evaluated and weighed from the respective standpoints of the participants
and the mediator. Though these standards are, technically, applicable only to general civil cases mediated within a superior
court's mediation program, they offer a comprehensive framework for the examination of what is or is not good practice in
the context of most mediation. Of interest to mediators, parties and attorneys, and having application to private and to court-connected
mediation, this program is designed to spark thought and discussion as to mediator disclosure and its bearing on providing
an impartiar process.
